Germany’s Bayer loses lawsuit to pay US$1.56 billion

Sin Chew Daily reported that the German pharmaceutical company Bayer lost another lawsuit over its herbicide Roundup causing cancer. A U.S. jury ruled that Bayer must pay US$1.56 billion (approximately RM7.274 billion) in compensation.

This is Bayer’s fourth loss in a lawsuit involving herbicides causing cancer. This move may affect Bayer’s litigation strategy and favor settlement.

When Bayer acquired Monsanto in 2018, it faced 165,000 related lawsuits. The company paid $10.9 billion in 2020 and settled more than 115,000 lawsuits, and currently has about 50,000 lawsuits remaining.

A jury on Friday found Monsanto, a unit of Bayer, liable for negligence and defective products in the cancer and death of four people who sued over its use of Roundup herbicide, according to court documents filed Friday in Cole County, Missouri.

The jury ordered Bayer to pay a total of US$61.1 million in damages to the plaintiffs, and each of them could receive US$500 million in punitive damages. However, the other plaintiff was only awarded $100,000 in damages.

Since the amount of punitive damages exceeds the guidelines of the U.S. Supreme Court, the amount will be adjusted if Bayer appeals.
