Apple’s backup plan to deal with import bans on the Apple Watch Series 9 and Ultra 2 involves software solutions that could take away blood oxygen monitoring capabilities.

Apple appeals the U.S. International Trade Commission (ITC) ruling while launching software solutions to deal with possible export bans. The ITC ruled in January 2023 that Apple Watch infringed Masimo patents and requested a ban on the import of Series 9 and Ultra 2. Apple had begun removing the two watches, but appealed after the ITC’s decision.

The report says Apple implemented the new design through a software update, removing the pulse oximetry feature. The ITC responded that Apple provided a “weak and unconvincing case” and emphasized that it requested an extension of the import ban for infringement. The final decision could impact demand and perceived value of the Apple Watch.
