eBay agreed to pay $59 million and improve its compliance program to resolve Justice Department charges that it failed to crack down on the purchase of equipment used to make counterfeit drugs.

This is the first time the Justice Department has reached a settlement with an e-commerce company that violated the federal Controlled Substances Act. The charges involve eBay’s failure to monitor pill presses and encapsulating machines sold on its site that were used to illegally manufacture counterfeit fentanyl-laced pills.

eBay violated recordkeeping and reporting regulations by failing to verify the identity of the purchaser with the U.S. Drug Enforcement Administration. Addressing this issue is critical to combating the flow of illicit drugs, particularly fentanyl-related drugs.
